Terms of use

Version 1.1.0 · Effective October 14, 2026

These terms are the agreement between you and Conduct Science Inc. for using Capillary Health: capillaryhealth.com, the scheduling app at schedule.capillaryhealth.com and the sign-in page at auth.capillaryhealth.com. By creating an account or using Capillary, you agree to them and to our privacy policy.

Who we are

Capillary Health is a product of Conduct Science Inc. ("ConductScience"), based in Skokie, Illinois. In these terms, "we" means ConductScience. "You" means the person using Capillary and, when you set up or manage a department, the organization you act for.

Capillary is offered to teams in the United States. If your organization has a signed agreement with us for Capillary, that agreement controls where it differs from these terms.

Your account

  • Use your real name and an email address you control, and keep your sign-in to yourself. You are responsible for what happens under your account.
  • If you set up a department or invite people to one, you confirm that your organization allows you to.
  • You must be 18 or older to use Capillary.

Using Capillary

Use Capillary only for lawful scheduling and the work around it. Do not:

  • try to reach accounts, departments or information that are not yours, or get around a limit or check in the service;
  • copy, scrape, resell or reverse engineer Capillary, except where the law allows it;
  • upload anything harmful, or use Capillary in a way that harms it or other users;
  • use Capillary to break a law, your organization's rules or someone else's rights.

We may suspend an account that does any of these.

Calendars and schedules you bring in

  • You may bring in a calendar, including your group's whole schedule on the Department tab, only if you are allowed to see and use it. A group schedule names your colleagues, so keep what Capillary shows you about them to your work.
  • Capillary reads calendars to show and check them. It never changes your scheduling system. A swap or trade agreed through Capillary happens only when the people in it enter it there, under its rules.
  • A swap request goes out in your name, to the colleagues you choose.

Suggestions, estimates and checks

  • Swap suggestions, how likely a colleague is to say yes, fatigue and alertness estimates, rest checks and analytics are estimates from the information Capillary has. They can be wrong or out of date.
  • They are not medical advice and do not replace your judgment, your organization's rules or the law, including limits on duty hours. You and your organization remain responsible for schedules, staffing and patient care.

Your information

  • You keep the rights you have in the information you put into Capillary. You give us permission to host, copy, process and show it to run Capillary for you and the people you share it with, including suggesting swaps to others from how people trade shifts and answer swap requests, to improve Capillary, and to develop new products and features, including by training and evaluating ConductScience's own models.
  • ConductScience owns the software, models and improvements it makes. We may use information that identifies no one, such as de-identified information or totals across many people, for any purpose. Deleting information does not undo models or totals that identify no one.
  • Where a business associate agreement covers patient information, we use that information only as the agreement allows. Patient information and information about people a department serves, such as students, go into our models only once de-identified.
  • Our privacy policy explains what we collect, who can see it and how to have it deleted.

Free and paid plans

  • Capillary's tools for individual clinicians are free. A department or organization pays what its order or agreement with us says, and that order sets billing and renewal.
  • We may change or end a free feature.
  • We host Capillary on Microsoft Azure, and we sign a business associate agreement on request for features that handle patient information.

Our software, patents and feedback

  • Capillary's software, designs, methods and content belong to ConductScience and are protected by copyright, trademark and patent law. These terms let you use Capillary as described here, and give no other rights.
  • Parts of Capillary's scheduling technology are patent pending. Our patents page lists them.
  • If you send us ideas or feedback, we may use them without owing you anything.

Ending your use

  • You can stop using Capillary at any time, and ask us to delete your account as our privacy policy explains.
  • We may suspend or close an account that breaks these terms. We may end a service with notice where we can give it.
  • Parts of these terms that by their nature should last, such as ownership, the limits on liability and governing law, continue after your use ends.

No warranty

We work to keep Capillary accurate and available, but we provide it "as is" and "as available". As far as the law allows, we make no warranties, including that Capillary will be free of errors, always available or fit for a particular purpose.

Limits on liability

As far as the law allows, ConductScience is not liable for indirect, incidental, special or consequential damages, or for lost profits, revenue or data. Our total liability for all claims about Capillary is limited to the greater of what you paid us for Capillary in the 12 months before the claim and $100.

If you use Capillary for an organization, the organization will cover our reasonable costs of a claim brought by someone else that arises from information it put into Capillary or from its breach of these terms.

Governing law

Illinois law governs these terms, without regard to its rules on conflicts of law. Any dispute goes to the state or federal courts in Cook County, Illinois, and you and we agree to their jurisdiction.

Changes to these terms

We may update these terms. We post each change on this page with a new version number and date. If you keep using Capillary after a change takes effect, the new terms apply. We may also ask you to accept updated terms in the app.
